These Terms and Conditions define the rights and obligations of the Service Recipient ("Client") and the Service Provider – Comfy Apartments Sp. z o.o., with its registered office in Gdynia at aleja Zwycięstwa 241/13, Tax ID (NIP) 5862412275, e-mail: info@comfyapartments.pl ("Comfy Apartments"), regarding reservations, accommodation services, or rentals in units offered by the Comfy Apartments brand, as well as rules for payment, complaints, and liability.

The Terms and Conditions constitute an integral part of the accommodation agreement concluded with Comfy Apartments in properties managed by Comfy Apartments.

Making a reservation is equivalent to accepting the provisions of these Terms and Conditions, which the Client can access at: comfyapartments.pl/Regulamin

Whenever these Terms and Conditions refer to:

Client – a natural person with full legal capacity as defined by the Civil Code, a legal person, or an organizational unit referred to in Art. 33¹ of the Civil Code, being a party to the accommodation or rental agreement for a unit offered by Comfy Apartments.
Comfy Apartments – the Service Provider, i.e., Comfy Apartments Sp. z o.o. based in Gdynia at al. Zwycięstwa 241/13, NIP: 5862412275.
Website – the website www.comfyapartments.pl owned by Comfy Apartments and the booking platform contained therein.
Agreement – the total mutual rights and obligations of the parties resulting from the accommodation agreement in units offered by Comfy Apartments.
Service – the accommodation service provided by Comfy Apartments to the Client.
Total Service Price – the amount indicated during the booking process, including all dues resulting from the concluded Agreement.
Force Majeure – any external, inevitable phenomenon that could not have been predicted or resisted, in particular phenomena of a factual, legal, or administrative nature (e.g., flood, hurricane, earthquake, war). Force Majeure does not include: illness, car accident, revoked leave, cancelled flight, lack of documents, family and personal matters, etc.
Minors – a natural person who is at least 13 years old but has not yet reached 18 years of age.
§ 1

General Provisions

  1. These Terms and Conditions specify the conditions for booking and accommodation in units offered by Comfy Apartments, as well as the rules for payment, complaints, and liability of the parties to the Agreement.
  2. The correct use of the Website requires computer equipment that meets the following technical requirements:
    1. Internet access,
    2. An installed web browser (an up-to-date version is recommended),
    3. An active and correctly configured e-mail account.
  3. The correspondence address for Comfy Apartments is: al. Zwycięstwa 241/13, 81-521 Gdynia, and the e-mail address is: info@comfyapartments.pl.
§ 2

Subject of the Agreement

  1. The subject of the Agreement is the accommodation service in a unit offered by Comfy Apartments through the Website or intermediary portals used for concluding agreements with Comfy Apartments.
  2. Comfy Apartments is obliged to provide the Client with a unit consistent with the description on the Website or intermediary portal and within the dates specified in the reservation, and the Client is obliged to pay the Total Service Price specified during the reservation process.
  3. For the avoidance of doubt, the accommodation service includes only the stay in the unit. Other elements, such as the use of common areas of the building (e.g., SPA), access to cable TV, wireless Internet access, air conditioning, or parking access, constitute additional services offered alongside the accommodation service, and their absence cannot be the subject of claims by the Client.
  4. Making a reservation by the Client via the Website or an intermediary portal is equivalent to accepting these Terms and Conditions and concluding an Agreement between the Client and Comfy Apartments.
§ 3

Reservation and Payment Rules

  1. In the booking process, the Client selects a unit offered by Comfy Apartments via the Website or an intermediary portal, and then reserves the unit by filling out a virtual booking form, or makes a reservation by phone at +48 668 833 395 or via e-mail at info@comfyapartments.pl.
  2. The Client makes a reservation by specifying a specific start and end date of the stay, as well as the number of people who will be staying in the property. The stay is calculated in days. In the case of a reservation made by phone or e-mail, the reservation is effective after the Client receives a booking confirmation from Comfy Apartments via e-mail.
  3. Each offered unit is intended for accommodation by a maximum number of people as indicated in the offer. Staying in the unit with more people than indicated in the booking process must be agreed directly with Comfy Apartments before the stay begins and may result in an increase in the Total Service Price or refusal of the reservation.
  4. Booking confirmation occurs by delivering a message to the Client's e-mail address with information confirming the reservation, a summary of the offer, the Total Service Price, acceptance of the Terms and Conditions, and the reservation date.
  5. The Client is obliged, within 2 business days from receiving the confirmation, but no later than the day the Service begins, to pay a prepayment towards the Total Service Price through a chosen payment method available in the payment link sent to the provided e-mail address or, with prior consent from Comfy Apartments, by bank transfer to the account specified in section 8. Proof of transfer should be sent to finanse@comfyapartments.pl. The reservation fee is considered paid on the day it is credited to the Comfy Apartments bank account.
  6. The prepayment towards the Total Service Price is 40% of the Total Service Price specified for the given reservation, unless the offer clearly states otherwise.
  7. Failure to pay grants Comfy Apartments the right to withdraw from the agreement immediately, without the need to set an additional deadline for payment.
  8. Payment of the Total Service Price minus the prepayment made is done via the chosen payment method or by bank transfer to the Comfy Apartments bank account number: 70 1140 2004 0000 3502 8540 0406 or another indicated bank account. Payment should be made 14 days before the start of the stay, unless the offer clearly states otherwise or after confirmation with Comfy Apartments, at the latest during check-in using a payment card, BLIK, or cash.
  9. If the Client pays by transfer immediately before the stay starts, they are obliged to provide proof of transfer in PDF format upon request from Comfy Apartments.
  10. Failure to pay grants Comfy Apartments the right to terminate the Agreement with immediate effect, without the need to set an additional deadline and without the obligation to refund the prepayment.
  11. Payment is considered made on the day it is credited to the Comfy Apartments bank account.
  12. The Client is obliged to provide the information necessary for the booking process (specifically name and surname, residential address, contact phone number, e-mail address), while declaring their veracity.
  13. The standard proof of purchase for the Service is a receipt. If the Client requires an invoice for the stay, they are obliged to provide this information and the data for its issuance no later than 24 hours after making the payment to the e-mail: info@comfyapartments.pl.
§ 4

Conditions of Stay

  1. The stay in the unit begins no earlier than 15:00 on the first day specified in the Agreement and ends at 11:00 on the last day.
  2. Leaving the unit after 11:00 on the last day of the stay is possible only after prior telephone arrangement and acceptance by Comfy Apartments and may involve an additional fee. Vacating the unit must always occur by 15:00 on the last day of stay at the latest. Vacating after 15:00 will result in an additional fee equal to the price of the last night's stay, but not less than 300 PLN.
  3. In case of vacating the unit after 11:00 on the last day of stay without prior consent from Comfy Apartments, an additional fee equal to the price of the last night's stay will be charged, but not less than 300 PLN.
  4. On the day the stay begins, the unit is handed over at a time previously agreed with the Client, but no earlier than 15:00. Keys are handed over by a Comfy Apartments employee or by sending an access code for a key box or electronic lock via electronic means. Comfy Apartments is not responsible for any delays in handing over the unit caused by the Client's failure to notify their arrival time.
  5. The unit may only be handed over to the person indicated in the booking process or a person authorized by them in writing. The person who received access codes undertakes not to share this information with third parties. In case of sharing access codes, the person indicated in the booking process bears full responsibility for the unit and may be charged an additional fee of 1000 PLN.
  6. Checking in between 19:00 and 8:00 is an additional service and is only possible after prior notification and consent from Comfy Apartments. In such cases, an additional fee of 100 PLN will be charged.
  7. On the day of check-in, Comfy Apartments is entitled to request the Client to show an ID card or passport to confirm and record personal data.
  8. The Client is obliged to use the unit in a manner consistent with its purpose, the provisions of these Terms and Conditions, and the principles of social coexistence, specifically in a way that does not disturb the peace of third parties.
  9. Quiet hours apply in the units from 22:00 to 6:00.
  10. A maximum number of people corresponding to the number indicated in the reservation may stay in the unit. The presence of more people entitles Comfy Apartments to charge the Client an additional fee of 1000 PLN for each person over the limit and to terminate the Agreement with immediate effect.
  11. The Client bears full costs of any damage caused during the stay in the unit (including its equipment) or common parts of the building.
  12. Comfy Apartments has the right to terminate the Agreement with immediate effect without refunding collected funds if the Client or persons staying in the unit violate the Terms and Conditions, behave aggressively, or disturb the peace of third parties (specifically by organizing parties that violate social coexistence rules). If intervention by the Police, City Guard, property security, or a Comfy Apartments employee is necessary, an additional fee of 1000 PLN will be charged for each violation, which does not limit the possibility of seeking compensation under general rules.
  13. Smoking is strictly prohibited in the units, including tobacco products, electronic cigarettes, water pipes, etc. The prohibition does not apply to burning wood in the fireplace (if the unit has one). Additional fee for violation: 500 PLN, which does not limit the possibility of seeking compensation under general rules.
  14. The Client is obliged to care for the unit with due diligence, specifically by closing the entrance door and not taking unit equipment outside its area. If equipment is found missing, Comfy Apartments may charge the Client for the cost of purchasing the missing items.
  15. The Client is obliged to report any faults immediately upon discovery to Comfy Apartments.
  16. Comfy Apartments should provide the Client with a unit in a state suitable for the Service and maintain it in such state for the duration of the Agreement. Small outlays connected with ordinary use of the unit are the responsibility of Comfy Apartments.
  17. Waste segregation is mandatory in the units according to local government guidelines. In case of lack of segregation or incorrect segregation, Comfy Apartments may charge the Client an additional fee of 100 PLN.
  18. In case of a violation of the Terms and Conditions, reports of violations from neighbors, building administration, or the Police, and lack of payment for the stay, Comfy Apartments is entitled to enter the unit after a prior attempt to notify the Client by phone.
§ 5

Cancellation and Resignation

  1. Comfy Apartments and the Client have the right to withdraw from the agreement within 3 days from the occurrence of Force Majeure. In such cases, the Client is entitled to a refund of all paid amounts, except for costs incurred by Comfy Apartments related to preparing and cleaning the unit and processing payments and reservations.
  2. Lack of payments referred to in § 3 is considered a failure to perform the obligation within the meaning of the Civil Code.
  3. Up to five days before the agreed date of stay, the Client has the right to withdraw from the Agreement. In such cases, Comfy Apartments may retain all previously paid funds, unless the cancellation conditions in the offer state otherwise.
  4. Changing the booking date or changing the selected unit is possible only by mutual agreement of the parties. In the absence of agreement, section 3 above applies.
  5. Early departure of the Client from the unit does not entitle them to a refund for the unused part of the stay.
  6. If Comfy Apartments is forced to change significant conditions of the agreement, it immediately notifies the Client, who should inform whether they:
    1. Accept the proposed change to the Agreement, or
    2. Withdraw from the Agreement with effect on the day of withdrawal, which involves an immediate refund of paid amounts for the unused period. The Client has the right to withdraw within 3 days of notification.
  7. Comfy Apartments collects a refundable security deposit from the Client to cover potential damages in the unit and additional fees resulting from the Terms and Conditions. The amount of the security deposit depends on the selected unit and the length of stay. Information about the deposit amount is provided in the offer. The deposit is collected in cash, by transfer, or as a pre-authorization on the Client's credit card.
  8. The deposit is refunded to the Client within 7 days from the check-out date by releasing the credit card pre-authorization or by transfer.
  9. In case of charging the Client with additional fees or finding damage in the unit, the cost of repairs and additional fees will be deducted from the deposit. If the deposit does not cover the costs, the Client is obliged to pay the difference. This does not prevent seeking compensation under general rules.
§ 6

Liability

  1. Comfy Apartments is liable for non-performance or improper performance of the Agreement, unless caused solely by the action or omission of the Client or Force Majeure.
  2. The Client is responsible for any type of damage caused in the unit, caused by the action/omission of the Client, persons staying in the unit, or animals. Damages must be reported to Comfy Apartments within 1 day of their occurrence.
  3. The Client is not liable for damages caused by Force Majeure.
  4. Comfy Apartments is not responsible for items left in the unit during the stay and after check-out. Left items may be stored for 14 days and returned to the Client only in person at a location indicated by Comfy Apartments.
  5. In case of losing a key, access card, or garage remote, the Client will be charged for the replacement cost plus an additional fee of 100 PLN.
  6. Comfy Apartments is not responsible for damage to the Client's property in garages, parking spaces, and common areas of buildings.
  7. The Client undertakes to follow all fire safety and health and safety (BHP) rules and instructions applicable on the premises and assumes full responsibility for the consequences of non-compliance.
§ 7

Complaints

  1. All complaints should be submitted by the Client to Comfy Apartments in writing or electronically to reklamacje@comfyapartments.pl within no more than 14 days from the end of the stay.
  2. Comfy Apartments considers the complaint within 30 days of receipt and informs the Client via electronic means.
  3. In case of refusal to accept the complaint, Comfy Apartments is obliged to justify the reasons for refusal.
§ 8

Pets

  1. Comfy Apartments does not consent to the stay of animals in the units, subject to sections 2–4 below.
  2. A Client who wishes to stay in the unit with a pet is obliged to request individual consent from Comfy Apartments before making a reservation, specifying the unit and stay dates.
  3. Comfy Apartments will respond immediately via electronic means regarding the possibility of staying with a pet.
  4. If Comfy Apartments consents to a pet stay, it will charge the Client an additional fee for the pet's stay in the unit.
  5. The presence of animals in the unit without the consent of Comfy Apartments entitles it to charge the Client an additional fee of 500 PLN.
§ 9

Reservations by Minors

  1. Reservations and stays by Minors (13–18 years old) are only possible with the written consent of a guardian or legal representative, sent as a scan to the Comfy Apartments e-mail address.
  2. The scanned consent should be sent to info@comfyapartments.pl within 3 days of booking, but no later than 1 day before the stay date. In case of lack of consent within the deadline, the reservation is automatically cancelled.
  3. If it is found on the day of check-in or during the stay that the Client is a Minor, Comfy Apartments will immediately send an inquiry to the guardians, allowing 3 hours for confirmation. In the absence of confirmation, the Agreement is considered not concluded.
  4. Liability for obligations resulting from the Terms and Conditions (including damage to the unit) is borne by the guardian or legal representative of the Minor.
§ 10

Final Provisions

  1. For matters not regulated herein, the provisions of the Civil Code apply.
  2. The interior design of the units constitutes a work within the meaning of the Act on Copyright and Related Rights. Recording or distributing it without the consent of Comfy Apartments entitles it to impose an additional fee of 10,000 PLN.
  3. The Client declares that they have been informed of the content of Art. 38 point 12 of the Act of May 30, 2014, on consumer rights, according to which, in the case of service contracts for accommodation (other than for residential purposes), the consumer does not have the right to withdraw from a distance contract.
  4. The administrator of the Client's personal data is Comfy Apartments. Personal data will be processed, among others, for the purpose of executing the Agreement. More information in the privacy policy.
  5. Any disputes between Comfy Apartments and the Client will be resolved in accordance with Polish law by the court with local jurisdiction for Gdynia.
