Terms and Conditions

Bookings and stays at Comfy Apartments · effective from 10 October 2026. This is a translation; in case of discrepancies, the Polish version prevails.

Key information at a glance

These terms and conditions explain how to book an apartment with Comfy Apartments, how to pay for it and which rules apply during your stay. We have put the key information at the top, and all additional charges in one place – § 14.

§ 1

Service provider, contact details and definitions

  1. The service provider is Comfy Apartments spółka z ograniczoną odpowiedzialnością (a limited liability company) with its registered office in Gdynia, al. Zwycięstwa 241/13, 81-521 Gdynia, entered in the register of entrepreneurs of the National Court Register (KRS) by the Sąd Rejonowy Gdańsk-Północ w Gdańsku, VIII Wydział Gospodarczy KRS (District Court Gdańsk-Północ in Gdańsk, VIII Commercial Division of the National Court Register), under KRS number 0001141242, NIP (tax number) 5862412275, REGON 540297170, share capital PLN 5 000 (“Comfy Apartments”).

  3. Capitalised terms used in the Terms have the following meanings:
    Terms – these terms and conditions for bookings and stays;
    Guest – the party that concludes the Agreement with Comfy Apartments: an adult natural person with full legal capacity, a legal person, or an organisational unit referred to in Art. 33¹ of the Civil Code (Kodeks cywilny);
    Consumer – a Guest who is a natural person booking a stay not directly connected with their business or professional activity. The provisions concerning Consumers also apply to a natural person running a business if the Agreement is not of a professional nature for that person;
    Stay Participants – the Guest and all persons named in the booking as staying in the Apartment;
    Apartment – a unit offered by Comfy Apartments, together with its furnishings and equipment and – if the Offer so provides – a parking space or access to the common areas of the building;
    Offer – the description and price list of an Apartment on the Website or on a Booking Platform, including the specific rules for that Apartment (e.g. deposit, pets, parking, smoking area, swimming pool rules);
    Website – the website www.comfyapartments.pl together with its booking system;
    Booking Platform – a third-party booking service, e.g. Booking.com or Airbnb;
    Direct Booking – a booking made directly with Comfy Apartments: on the Website, by phone or by e-mail;
    Agreement – the agreement for the provision of short-term accommodation in an Apartment;
    Rate – the price option chosen when making a Direct Booking, which determines the amount of the prepayment and the refund rules in the event of cancellation;
    Total Price – the amount shown during the booking process, comprising the price of the nights, the mandatory charges specified in the Offer (e.g. a service fee covering final cleaning) and the local or spa fee. The Deposit and additional services ordered separately are not part of the Total Price;
    Deposit – the refundable security described in § 6;
    Registration Form – the electronic form that the Guest completes and signs before arrival (§ 7);
    Entry Instructions – the access codes (for an electronic lock or a key box) and the information needed to enter the Apartment without assistance;
    Force Majeure – an external event that could not have been foreseen or prevented, e.g. a flood, a hurricane, war or a decision by the authorities that makes the stay impossible. In particular, illness, an accident, a cancelled holiday or flight, missing documents, and family or personal matters do not constitute Force Majeure.
§ 2

Scope of the Terms and conclusion of the Agreement

  1. The Terms set out the rules for booking, paying for and staying in the Apartments, as well as the rights and obligations of the Guest and of Comfy Apartments. They form part of the Agreement.
  2. The Terms are available free of charge before booking at comfyapartments.pl/Regulamin, in a form that allows them to be downloaded, saved and printed. A link to the Terms is also included in the booking confirmation and in the Entry Instructions.
  3. For a Direct Booking, the Agreement is concluded when Comfy Apartments confirms the booking by e-mail; if Comfy Apartments does not confirm the booking, it refunds any payment collected without delay. For a booking via a Booking Platform, the Agreement is concluded in accordance with the rules of that Booking Platform.
  4. If the Guest books via a Booking Platform, payments, the prepayment, the Deposit, the prices of additional services and the cancellation rules are governed by the terms of the option that the Guest selected and accepted on that Booking Platform at the time of booking (§ 5(1)). The other provisions of the Terms, including the house rules and the charges under § 14, apply if the Guest was able to read them before booking, e.g. in the Offer description or in the house rules on the Booking Platform.
  5. Each booking is governed by the Terms in force on the day it was made.
§ 3

Booking

  1. Bookings can be made on the Website, on a Booking Platform, by phone or by e-mail. The booking must be made by an adult.
  2. When booking, the Guest provides the arrival and departure dates, the number of people (including children) and their own full name, address (needed for the invoice), e-mail address and phone number and – if they want an invoice issued to a company – the company name and NIP (tax number). The Guest is responsible for the accuracy of the information provided.
  3. The number of Stay Participants may not exceed the maximum number of people stated in the Offer. Changing the number of people after booking requires the consent of Comfy Apartments and may change the price.
  4. The booking confirmation contains: the name of the Apartment, the dates of the stay, the number of people, the Total Price, the selected Rate, the amount of the Deposit (if applicable) and a link to the Terms.
  5. The Consumer does not have the statutory right to withdraw from a distance contract, because the Agreement concerns accommodation on specified dates – Art. 38(1)(12) of the Consumer Rights Act (ustawa o prawach konsumenta). However, the Guest may cancel the booking under the rules set out in § 5.
§ 4

Prices, payments and invoices

  1. Prices on the Website are gross prices (including VAT). The Total Price is shown before the booking is made.
  2. Comfy Apartments accepts only electronic payments made via a payment link handled by a payment operator (IdoPay or PolCard). It does not accept cash, payment on site or bank transfers directly to its bank account. A payment is made when the payment operator confirms it. For a booking via a Booking Platform, payment may also be collected by that Booking Platform (§ 2(4)).
  3. Paragraphs 3–5 apply to Direct Bookings. The prepayment is determined by the Rate (§ 5). For bookings on the Website, the prepayment is collected at the time of booking. For bookings by phone or e-mail, the Guest pays it via the payment link within 2 working days of receiving the link.
  4. The Guest pays the rest of the Total Price via the payment link no later than 14 days before the arrival date. If the booking is made less than 14 days before the arrival date, the Guest pays the rest within 2 working days of receiving the payment link – and in any case before the Entry Instructions are sent.
  5. If the Guest does not pay on time, Comfy Apartments sets an additional deadline by e-mail of at least 3 days or, if fewer than 7 days remain until the arrival date, of at least 24 hours. If this deadline passes without payment, Comfy Apartments may withdraw from the Agreement; payments are then settled as if the Guest had cancelled on the date of withdrawal (§ 5).
  6. The Total Price includes the local fee, known as the tourist tax (Gdańsk, Gdynia), or the spa fee (Sopot). It is charged to the persons liable for it, in the amount set by a resolution of the council of the municipality in which the Apartment is located and in accordance with the Local Taxes and Fees Act (ustawa o podatkach i opłatach lokalnych). Comfy Apartments collects it as a collection agent appointed by the municipal council. Its amount is shown during the booking process. A Stay Participant who is not liable for the fee or is exempt from it by law may notify Comfy Apartments of this and provide proof no later than at check-out – Comfy Apartments will then refund the fee collected from them. Comfy Apartments refunds the local or spa fee paid for each night that a Stay Participant did not spend in the Apartment (e.g. in the event of cancellation, a no-show, early departure, withdrawal from or termination of the Agreement) – regardless of the Rate and of how the booking was made. The refund is made within 14 days of receipt of the cancellation and, in other cases, within 14 days of the check-out date stated in the booking, using the same method the Guest used to pay.
  7. For every stay, Comfy Apartments issues a VAT invoice – in the Guest's own name or in a company's name – within 24 hours of check-out and sends it to the Guest's e-mail address or, if the Booking Platform has not shared the Guest's e-mail address, in a message via that Booking Platform. The Guest agrees to receive invoices electronically. An invoice is issued in a company's name if the Guest provides the company name and NIP (tax number) by the end of the stay at the latest, preferably when booking; otherwise Comfy Apartments issues an invoice in the Guest's own name. Invoices for businesses are issued in the National e-Invoicing System (Krajowy System e-Faktur, KSeF). Comfy Apartments issues advance invoices for prepayments.
  8. Additional services (e.g. parking, a baby cot, breakfast) are available according to the Offer's price list, and early check-in and late check-out under the rules in § 7(8). Additional services must be paid for before they are used – via a payment link or, if the Booking Platform requires it, via that Booking Platform.
§ 5

Cancellation and changes to bookings

  1. The rules for prepayment, cancellation and refunds depend on where the Guest booked the stay:
    1. Direct Booking (comfyapartments.pl, phone, e-mail) – the terms of the Rate selected at the time of booking apply (on the Website: “Refundable offer” or “Non-refundable offer”), as described in paragraphs 2–4. The terms of the Rate are shown before booking and in the booking confirmation;
    2. Booking via a Booking Platform (e.g. Booking.com, Airbnb) – the terms of the option that the Guest selected and accepted when booking on that Booking Platform apply. Cancellations are made through that Booking Platform, and refunds are made according to its rules.
  2. Refundable Rate: a prepayment of 40% of the Total Price, payable at the time of booking (for bookings by phone or e-mail – within the deadline in § 4(3)). In the event of cancellation:
    1. no later than 7 days before the arrival date – 100% of the payments made are refunded;
    2. later, but no later than 3 days before the arrival date – 50% of the payments made are refunded, and the local or spa fee is refunded in full (§ 4(6));
    3. later than 3 days before the arrival date or in the event of a no-show – payments are non-refundable, subject to paragraph 4 and except for the local or spa fee (§ 4(6)).
  3. Non-refundable Rate: 100% of the Total Price, payable at the time of booking (for bookings by phone or e-mail – within the deadline in § 4(3)), in return for a lower price. The payment is non-refundable in the event of cancellation, a no-show or a shortened stay, except for the local or spa fee for unused nights (§ 4(6)).
  4. Refund if the Apartment is re-let. This applies to the Refundable Rate where the Guest cancels later than 3 days before the arrival date, does not arrive or leaves early. If Comfy Apartments lets the same Apartment to another guest for the same nights, it refunds the Guest 50% of the price of each re-let night – based on that night's price in the Guest's booking, excluding the service fee and the local or spa fee (Comfy Apartments refunds that fee in full – § 4(6)). The 50% retained covers the costs of reselling the night at short notice, in particular the Booking Platform's commission, the price reduction and additional cleaning. For nights that could not be re-let, payments are non-refundable, except for the local or spa fee. Comfy Apartments informs the Guest by e-mail of the re-let nights and the amount of the refund.
  5. The Guest cancels by e-mail to info@comfyapartments.pl or, for a booking via a Booking Platform, through that Booking Platform. The date on which the cancellation is received is decisive. The refund is made within 14 days of receipt of the cancellation, and a refund under paragraph 4 within 14 days of the check-out date stated in the booking. Every refund is made using the same method the Guest used to pay.
  6. The dates of the stay or the Apartment may be changed by agreement between the parties. If the parties do not reach agreement and the Guest does not intend to use the booking, the cancellation rules apply.
  7. Leaving early does not entitle the Guest to a refund of the price for unused nights, unless the early departure was caused by circumstances for which Comfy Apartments is responsible. Under the Refundable Rate, paragraph 4 applies accordingly. Comfy Apartments refunds the local or spa fee for unused nights under § 4(6).
  8. If Force Majeure makes the stay impossible, either party may withdraw from the Agreement by notifying the other party without delay. The Guest then receives a refund of all payments within 14 days of the withdrawal, regardless of the selected Rate.
  9. If the Apartment cannot be made available for reasons beyond the Guest's control (e.g. a breakdown, flooding, a decision by the building manager), Comfy Apartments informs the Guest without delay and proposes, at no extra charge, another Apartment of at least the same standard. The Guest may accept the proposal or withdraw from the Agreement and receive a refund of all payments (or, during the stay, of the payments for unused nights). This does not exclude the Guest's right to compensation under general rules if the failure to perform the Agreement results from circumstances for which Comfy Apartments is responsible.
§ 6

Refundable Deposit

  1. If the Offer provides for a Deposit, its amount is stated in the Offer and in the booking confirmation. The Deposit secures any damage and the charges under § 14. Some Apartments do not require a Deposit.
  2. The Guest pays the Deposit only via a payment link – either as a payment or as a hold (pre-authorisation) on a payment card. The link is sent a few days before arrival, and the Deposit can be paid at the latest just before entering the Apartment. The Entry Instructions are sent only after the Deposit has been paid.
  3. The Deposit is refunded, or the hold released, within 7 days of check-out, usually within 48 hours.
  4. If Comfy Apartments deducts the cost of damage or charges under § 14 from the Deposit, it informs the Guest by e-mail before the refund deadline expires, stating the amount and the reason and sending evidence (e.g. photos, an invoice or a cost estimate). If the Deposit does not cover the amount due, the Guest pays the difference via a payment link.
  5. For a booking via a Booking Platform, a Deposit is collected only if the terms shown on that Booking Platform at the time of booking provide for it, and in accordance with those terms.
§ 7

Arrival, Registration Form and check-out

  1. The Apartment is at the Guest's disposal from 15:00 on the arrival date until 11:00 on the departure date.
  2. Check-in is self-service and possible at any time from 15:00, with no extra charge for late arrival. If the Offer provides for key collection at set times, the times stated in the Offer apply.
  3. A few days before arrival, the Guest receives a link to the Registration Form. In the Registration Form, the Guest enters the full name of the person who will receive the Entry Instructions and the series and number of that person's ID card or passport, and then signs the form. Comfy Apartments does not make copies, scans or photos of documents. The data in the Registration Form is used to confirm the identity of the person who receives access to the Apartment (the Apartments have no reception desk), to ensure the safety of the Stay Participants, the neighbours and the building, and to pursue any claims (§ 16).
  4. Comfy Apartments sends the Entry Instructions on the arrival date if all three of the following conditions are met: (a) the Total Price has been paid, (b) the Registration Form has been completed and signed, (c) the Deposit has been paid – if the Offer provides for one. Comfy Apartments is not responsible for any delay resulting from any of these conditions not being met. If the conditions are not met by 10:00 on the day after the arrival date, paragraph 9 applies.
  5. Access codes must not be passed on to anyone who is not a Stay Participant.
  6. Where there are reasonable doubts (e.g. inconsistent details or a suspected unauthorised payment), Comfy Apartments may ask to see an identity document or the card used for payment. If the Guest refuses to show the document, or if it turns out that the Guest provided false information, Comfy Apartments may refuse to make the Apartment available and withdraw from the Agreement; payments are then settled as if the Guest had cancelled on the date of withdrawal.
  7. At check-out, the Guest closes the windows and doors and leaves the keys, cards and remote controls as set out in the Entry Instructions (e.g. in the key box).
  8. Early check-in and late check-out are possible if agreed with Comfy Apartments in advance and subject to the Apartment's availability, for a charge of PLN 100 gross for each of these services (§ 14). Staying in the Apartment after 11:00 without the consent of Comfy Apartments results in the charge set out in § 14.
  9. If the Guest does not arrive by 10:00 on the day after the arrival date, or the conditions in paragraph 4 have not been met by then, Comfy Apartments may treat the booking as unused and cancel the remaining nights, unless it has previously confirmed a later arrival to the Guest. Payments are then settled as for a no-show (§ 5).
§ 8

House rules

  1. The Apartment is intended for the rest and accommodation of the Stay Participants. Without the written consent of Comfy Apartments, it may not be sublet, used for any commercial activity or used for photo or video shoots for commercial purposes. Photos and recordings for private use, including those published in reviews of the stay, do not require consent.
  2. Quiet hours in the Apartments are 22:00–7:00. During the day, too, Stay Participants must not disturb the neighbours.
  3. Parties, gatherings and celebrations, including stag and hen parties, are not allowed in the Apartments.
  4. Only Stay Participants may stay overnight in the Apartment, and their number may not exceed that stated in the Offer. Visitors may be in the Apartment during the hours 8:00–22:00, and the total number of people in the Apartment may not exceed the limit stated in the Offer.
  5. Stay Participants must comply with the rules of the building, its common areas, swimming pool, spa and garage (including vehicle size restrictions), as indicated in the Offer or in the Entry Instructions.
  6. Stay Participants must take care of the Apartment: close the doors and windows when going out, not take away any of the furnishings or equipment, not move heavy furniture and not throw anything out of the windows or off the balconies.
  7. Waste must be sorted in accordance with the rules of the municipality and the building, and left or taken out as described in the Entry Instructions.
  8. Smoke and carbon monoxide detectors must not be covered, removed or switched off. Stay Participants must follow the building's fire safety instructions.
  9. Building facilities run by the building manager (e.g. a swimming pool, spa, gym or garage) may be temporarily unavailable because of an inspection, a breakdown or a decision by the manager. Comfy Apartments notifies the Guest of such unavailability in advance if it knows about it beforehand. If the Guest paid separately for a facility they could not use, they receive a refund of that charge, and if the facility was an essential feature of the Offer, they may request an appropriate price reduction.
  10. The Guest is responsible for the conduct of the Stay Participants and of anyone the Guest lets into the Apartment as for their own conduct.
  11. If the house rules are breached, Comfy Apartments will ask for the breach to stop. In the event of a serious or persistent breach – in particular a party, disturbing the peace despite a request to stop, exceeding the number of people, aggression, possession of narcotic drugs or a threat to safety – Comfy Apartments may terminate the Agreement with immediate effect, and the Stay Participants must leave the Apartment without delay. In that case Comfy Apartments does not refund the price for unused nights (it refunds the local or spa fee under § 4(6)). However, if it re-lets the Apartment for those nights, it refunds the Guest – regardless of the Rate – 50% of the price of each of them, under § 5(4) and (5). It may also apply the charges under § 14 and claim compensation for damage.
§ 9

Smoking, narcotic drugs and open flames

  1. Smoking and the use of tobacco products (including heated tobacco), electronic cigarettes, water pipes (shisha), dried cannabis (including CBD) and any other substances taken by smoking or vaping are prohibited in the Apartments, on balconies, terraces and loggias, and in the common areas of the buildings.
  2. If the Offer or the Entry Instructions indicate a designated smoking area – on the balcony or elsewhere on the building's premises – tobacco products, electronic cigarettes and other legal smoking products may be smoked there. The Guest must then use an ashtray, close the balcony door and not throw cigarette ends off the balcony or onto the grounds around the building.
  3. Bringing in, possessing and using narcotic drugs, psychotropic substances and new psychoactive substances is prohibited in the Apartment and throughout the building. A breach of this prohibition is grounds for terminating the Agreement with immediate effect and may be reported to the Police.
  4. Open flames, including candles, incense, lanterns, barbecues and fireworks, must not be used, including on balconies and terraces. The only exception is a fireplace, if the Apartment has one – used in accordance with its operating instructions.
  5. A breach of the smoking ban results in the charge set out in § 14, which covers in particular ozone treatment, laundering of textiles and taking the Apartment off the market while the smell is removed. The Guest is separately liable for any damage (e.g. burn marks) and must either repair it or pay the cost of repair.
§ 10

Pets

  1. Staying with a pet is possible only in Apartments whose Offer expressly allows it, under the rules and for the charge set out in the Offer's price list. The pet must be declared at the time of booking.
  2. Pets are not allowed in the other Apartments. Arriving at such an Apartment with a pet results in the charge set out in § 14.
  3. The Guest is responsible for the pet: cleans up after it, does not leave it unattended if it might disturb the peace or damage the furnishings, and pays for any damage it causes.
  4. The ban does not apply to an assistance dog accompanying a person with a disability. An assistance dog may stay in any Apartment at no additional charge; Comfy Apartments only asks to be informed before arrival.
§ 11

Children and minors

  1. The booking must be made by an adult.
  2. Minors (persons under 18) may stay in the Apartment only under the supervision of an adult Stay Participant. The Guest is liable for any damage caused by minors.
  3. If only minors are staying in the Apartment, Comfy Apartments may refuse to make the Apartment available (payments are then settled as for a no-show, § 5) or terminate the Agreement under § 8(11).
§ 12

Defects, damage and access to the Apartment

  1. Comfy Apartments is responsible for the proper performance of the Agreement and provides the Apartment clean, in good working order and as described in the Offer.
  2. The Guest must report any defects or missing items without delay – ideally within a few hours of entering, with a photo – by phone or e-mail. Comfy Apartments fixes them as quickly as possible. If a defect cannot be fixed and it significantly affects the stay, Comfy Apartments offers another Apartment of at least the same standard or an appropriate price reduction. This does not exclude the Guest's right to compensation under general rules if the defect results from circumstances for which Comfy Apartments is responsible.
  3. The Guest is liable for damage caused by the Stay Participants, visitors and pets in the Apartment and in the common areas of the building, and must report it without delay. The amount of the damage is determined on the basis of an invoice, a cost estimate or the purchase price of the missing or damaged item.
  4. The Guest pays the actual cost of extra cleaning or laundry (e.g. in the case of heavy soiling, rubbish left behind or stains requiring specialist cleaning).
  5. During the stay, Comfy Apartments enters the Apartment: (a) without notice – only in emergencies such as a breakdown, flooding, fire, a threat to life, health or property, or an intervention by the emergency services, and informs the Guest without delay; (b) for other purposes, e.g. repairs or inspections – at a time agreed with the Guest. After the end of the stay or the termination of the Agreement, Comfy Apartments enters the Apartment after attempting to contact the Guest.
§ 13

Items left behind after check-out

  1. Comfy Apartments is not liable for items left in the Apartment after check-out, unless their loss or damage was caused through the fault of Comfy Apartments or of persons acting on its behalf.
  2. Comfy Apartments keeps items found for up to 12 months and informs the Guest by e-mail. At the Guest's request, it hands them over at an agreed place or sends them by courier or to a parcel locker. If items are sent, the Guest pays the shipping cost and a fee of PLN 70 gross for preparing and dispatching the parcel. After 12 months, Comfy Apartments proceeds in accordance with the Lost Property Act (ustawa o rzeczach znalezionych).
  3. Comfy Apartments returns any identity documents found to the Guest without delay or, if this is not possible, hands them over to the Police or another competent authority. Food and other perishable items are disposed of immediately.
§ 14

Additional charges – overview

  1. In addition to the Total Price, services ordered according to the Offer's price list and the cost of damage (§ 12(3)), only the charges listed in the table may be applied. Charges for breaching prohibitions are contractual penalties: they cover typical costs such as ozone treatment, laundering of textiles, extra work by staff or taking the Apartment off the market. The other items in the table are reimbursements of costs and fees for services performed at the Guest's request. All amounts in the Terms are gross amounts.

  2. Comfy Apartments applies charges for breaches after sending the Guest an e-mail describing the breach, together with evidence (e.g. photos, a security report). The charge is deducted from the Deposit or the Guest pays it via a payment link. The Guest may raise objections within 7 days of receiving this information – Comfy Apartments handles them as a complaint (§ 15). Charges for early check-in and late check-out are payable under § 4(8).
  3. Contractual penalties do not include the cost of repairing damage. The Guest is separately liable for damage under § 12(3).
§ 15

Complaints and disputes

  1. Concerns are best raised during the stay, by phone or e-mail – Comfy Apartments can then resolve the problem straight away.
  2. A complaint can be submitted by e-mail to reklamacje@comfyapartments.pl or info@comfyapartments.pl, or in writing to the registered office address of Comfy Apartments. Comfy Apartments asks for complaints to be submitted within 14 days of check-out; this time limit does not restrict the Guest's statutory rights. The complaint should include the Guest's details, the booking number or dates, a description of the concerns and how the Guest would like the complaint to be resolved.
  3. Comfy Apartments responds to a complaint by e-mail within 14 days of receiving it. If no response is given within this period, the complaint is deemed accepted. If Comfy Apartments does not accept the complaint in full, the response includes the reasons and a statement as to whether Comfy Apartments agrees or refuses to take part in out-of-court dispute resolution.
  4. The Consumer may use out-of-court methods of dispute resolution, in particular the help of a municipal or district consumer ombudsman or of authorised bodies entered in the register kept by the President of the Office of Competition and Consumer Protection (UOKiK). A Consumer from another European Union country may contact the European Consumer Centre.
  5. The Agreement is governed by Polish law. Disputes with Consumers are heard by the court with jurisdiction under the general rules, and disputes with other Guests by the court with jurisdiction over the registered office of Comfy Apartments.
  6. The Terms do not limit the Consumer's rights under mandatory provisions of law.
§ 16

Personal data

  1. The controller of Guests' personal data is Comfy Apartments (contact details in § 1).
  2. Comfy Apartments processes the data needed for the booking and the stay, billing and invoicing, collection of the local or spa fee, handling the Registration Form, ensuring safety and pursuing claims. The legal bases, recipients (including the providers of the booking, guest registration and payment systems, Booking Platforms and the accounting firm), retention periods and the Guest's rights are described in the Privacy Policy available on the Website.
  3. Providing the data in the Registration Form is a condition for sending the Entry Instructions – without it, the Apartment cannot be made available, because the Apartments have no reception desk. Comfy Apartments keeps the data from the Registration Form, including the series and number of the ID card or passport, for no longer than 14 days after check-out, unless it is needed to investigate damage or pursue claims.
§ 17

Electronic services

  1. On the Website, Comfy Apartments provides the following services electronically and free of charge: access to the booking form and contact forms and – for those who sign up – a newsletter.
  2. To use the Website, you need internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active e-mail address.
  3. The form service is provided from the moment the user starts using a form until the form is sent or the user stops using it. The newsletter is sent until the user unsubscribes, which can be done at any time.
  4. Users of the Website must not submit unlawful content.
  5. Complaints about electronic services are submitted and handled in accordance with § 15.
  6. Using the internet involves typical risks, e.g. malware, phishing or interception of data. Comfy Apartments never asks for payment card details by e-mail or via a messaging app – it accepts payments only via a payment operator's link or through a Booking Platform.
§ 18

Final provisions

  1. Matters not covered by the Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  2. Comfy Apartments may amend the Terms for important reasons, such as changes in the law, in the scope of its services or in payment systems. An amendment does not apply to bookings made before the date on which it takes effect.
  3. The Terms are available in several language versions. In the event of any discrepancy, the Polish version prevails.
  4. The Terms are effective from 10 October 2026.

Bookings made until 9 October 2026 are governed by the previous version of the terms.
